Accident Line Protect is an after the event insurance policy, purchased after the accident has occurred, which provides all the protection you need. If you lose your case, the policy will pay all the opponent’s costs you are responsible to pay. It will pay the disbursements that have been incurred by your solicitor on your behalf. It will also pay for the cost of the premium itself - truly “No win, No Cost” insurance.

The Premium - so there is a cost after all?

A premium is payable for “Accident Line Protect” which is issued when the Conditional Fee Agreement is signed. However, there are funding schemes available to pay this premium for you. These same schemes can be used to pay the disbursements incurred by your solicitor on your behalf. Remember - the premium is paid for by the insurance if you lose.

So who pays the premium and solicitors charges and success fee if you win?

The law allows for you to recover your after the event insurance premium from your defeated opponent as long as it is not unreasonable. “Accident Line Protect” premiums have been designed to be reasonable. You will be able to recover your solicitor’s basic charges, disbursements and success fee from your opponent as long as these are considered to be reasonable.

There may be certain elements, for example the costs relating to the funding of your case (ie loan facility costs for funding your insurance premium) that may not be recoverable. Your solicitor will explain this in detail when you sign your conditional fee agreement.
