The No Win No Fee Agreement
The Accident Line Protect Scheme provides a genuine risk free litigation
service. The normal rule is that whoever wins has their costs paid
by the loser. Accident Line Protect means that if you lose you will
not be liable for the other side’s costs.
If you win then your opponent will pay the majority of your costs
enabling you to obtain maximum benefit from your damages.
How Are Costs Calculated
- Costs are calculated on an hourly basis.
- In addition to the hourly basis a success fee is calculated
based on a percentage uplift of the basic costs.
- Due to new rules the defendants will pay your basic costs and
the uplift.
- If the uplift is reduced by agreement or by the court then you
will not be liable for the difference.
- Costs are very important as some claims companies may take the
lion’s share of damages. It is important that any agreement
is considered very carefully.
- We only use the Law Society approved conditional fee agreement
and the Law Society approved after event insurance product.
- We feel that this provides the client with the fairest and most
comprehensive package.
Other Methods of Funding
We will be more than happy to discuss with you other possible methods
of funding. Unfortunately now, legal aid has largely been withdrawn
for personal injury accidents. A conditional fee agreement is suitable
for the vast majority of clients. However, you may wish to fund
the matter privately or alternatively you might have an existing
form of legal expense insurance which we will be happy to review
with you.
We appreciate that clients seeking compensation do not wish to
expose themselves to the risk of having to pay out money. We want
to make the question of costs totally transparent and we will be
more than happy to discuss any aspect of costs with you during the
initial free consultation.
Disbursements
Disbursements are the expenses that we have to pay out on your
behalf in order to bring your claim. They will include such items
as medical report fees, obtaining your medical notes, court fees
and other expenses. As part of the Accident Line package we can
offer funding from the Bank of Ireland. This means that you do not
have to pay out anything in advance.
Deductions From Your Compensation
As we have said, it is our intention that you receive the maximum
amount of compensation at the end of the case.
We aim to ensure that you receive as much as possible. Possible
deductions include :
- If your case is unusually complex or difficult
- If your case goes on for a long time
- If you have had to fund some disbursements and interest becomes
payable.
