HOW LONG WILL IT TAKE?
There are two main factors on how long it will take for your claim
to be concluded.
- The severity of your injuries
- Your opponent and their insurers
The Severity of Your Injuries
Your injuries are recorded in a medical report which will be commissioned
from an independent specialist. This will usually mean going to
see a consultant.
- You should not settle your claim until the full extent of your
injuries are known.
- Therefore you either need to have fully recovered or the medical
report will have to set out what your continuing disability will
be.
- Often consultant orthopaedic surgeons will not provide confirmation
of a continuing residual disability until quite a considerable
time after the accident as you have to be given the chance to
get better.
- If your injuries get better then we can conclude your case.
If they do not then you may need another up dating medical report.
The Defendant and/or their Insurer
Court rules state that the defendant or their insurer should respond
within certain set time limits.
- Response from the defendant may not be a proper one.
- Sometimes it is necessary to issue court proceedings in order
to obtain a formal response.
- Quite often the defendants will not put forward a reasonable
offer to begin with.
- We are proactive in litigation and we will push the case forward
in order to achieve a proper settlement for the type of injury.
How Long in Months
Due to the above factors it is very difficult to say exactly how
many months different types of cases will take. As a rough guide
a simple claim where the injuries resolve themselves say within
six months will probably take about six to nine months to settle.
More complicated medical issues will take quite a lot longer as
it would take a lot of time in order to eventually see what all
of your losses would be. However, if the case is likely to take
sometime because of the severity of the injuries we can apply for
the payment of interim damages from the defendant. This will enable
you to make life more comfortable whilst waiting for the conclusion
of the case.
